At a high level, the Clear Cooperation Policy says:
If you are publicly marketing a property, it must be submitted to the MLS within one business day.
So what counts as “public marketing”?
- Social media posts 📱
- Email blasts 📧
- Flyers and mailers 📬
- Websites 🌐
- Basically anything beyond one-to-one communication
Once you cross that line into public exposure, the listing needs to be in the MLS.
🔒 What Are Office Exclusives and Private Listings?
These are properties that are:
- Not listed in the MLS
- Shared only within a brokerage or limited network
- Marketed in a more controlled, private way
And yes—they are allowed… but only as long as they are NOT publicly marketed.
